Service agreement and conditions

These terms of service govern your use of Creatif Freelance services and establish the legal agreement between you and our business.

Service Agreement

Scope of Services

Creatif Freelance provides professional creative services including but not limited to:

  • • Web design and development
  • • Brand identity and logo design
  • • Marketing materials creation
  • • Digital strategy consulting
  • • Content creation and copywriting
  • • User experience (UX) design

Specific project deliverables, timelines, and requirements will be detailed in individual project agreements or statements of work.

Payment Terms

Payment Schedule

  • Project Deposit: 50% due upon project commencement
  • Milestone Payments: As outlined in project agreement
  • Final Payment: Due upon project completion
  • Monthly Retainers: Due on the 1st of each month

Payment Methods

  • • Bank transfer (ACH/Wire)
  • • Credit card (Visa, MasterCard, Amex)
  • • PayPal Business
  • • Check (by arrangement)

Late Payment Policy

Invoices are due within 30 days. Late payments incur a 1.5% monthly service charge. Work may be suspended for accounts over 60 days past due.

Intellectual Property Rights

Work Product Ownership

Upon full payment of all fees, client receives full ownership rights to custom work created specifically for their project. This includes designs, code, content, and other deliverables as specified in the project agreement.

Pre-existing Materials

Creatif Freelance retains ownership of pre-existing intellectual property, methodologies, and general knowledge. Client receives a license to use incorporated pre-existing materials as part of the delivered work.

Third-Party Content

Client is responsible for obtaining proper licenses for any third-party content, stock photos, fonts, or software requested for use in the project. Creatif Freelance can assist with licensing but costs are separate.

Portfolio Usage Rights

Creatif Freelance reserves the right to display completed work in portfolios, case studies, and marketing materials unless confidentiality is specifically required and agreed upon in writing.

Client Responsibilities

Project Cooperation

  • • Provide timely feedback and approvals
  • • Supply accurate content and materials
  • • Respond to communications within 48 hours
  • • Make payments according to schedule

Legal Compliance

  • • Ensure content legality and accuracy
  • • Obtain necessary permissions and licenses
  • • Comply with applicable laws and regulations
  • • Respect intellectual property rights

Termination & Dispute Resolution

Project Termination

Either party may terminate a project with 14 days written notice. Client remains responsible for payment of completed work and expenses incurred. Refunds for unused deposits will be processed within 30 days.

Dispute Resolution

Disputes will first be addressed through good faith negotiation. If unresolved, binding arbitration will be conducted under the rules of the American Arbitration Association in New York State.
